Child Custody

The issue of the custody of a child arises after the completion of the divorce or the judicial separation and is one of the most important issues on which the court must decide. Custody of a child refers to the right given to a parent by the court to look after the child (if the child is less than 18 years of age). The parent in whom the custodial right is vested is supposed to look after the financial security, maintenance of the child with regard to proper lifestyle, healthcare, emotional, physical and medical development. The other parent is provided with the only right to access and meet the child. The family courts while debating on the issue of custody, base their decision on the best interests of the child in question in order to save the child from trauma that he/she may undergo or has undergone on account of separation/divorce or pending litigations between the parents.  

In India four forms of Child Custody are available i.e., Physical custody to one of the parents, Joint custody to the parents in turns, Sole custody and Third-party custody.

Custodial rights are dealt with in according to the religion being followed by the parents under the Hindu Marriage Act 1955, the Hindu Minority and Guardianship Act 1956, Muslim law, Divorce Act 1869 for Christian, the Guardians and Wards Act, 1890 for Parsi and Special Marriage Act-1954 in case of the parents belonging to different religions.

Domestic Violence

In order to protect the women from acts of domestic violence, the Protection of Women from Domestic Violence Act, 2005 (in short the DV Act) was enacted and this came into force from 26 October 2006.  Domestic Violence includes causing any harm or injury to the safety, life, health or well-being of the aggrieved woman by committing any physical, sexual, verbal or economic abuse. Moreover, it also includes any injury or harm done to the aggrieved woman or her relative with a view to coerce her or any person, to meet unlawful dowry demand. Threats to commit violence are also covered under the domestic violence. The DV Act protects the rights of women guaranteed to them under the Indian Constitutional, to achieve a violence free home and focuses on the reliefs given to the aggrieved woman such as maintenance, child custody, compensation, protection, right to residence in the “shared household”, among others.
